Intermittent issues like this could easily be the modem, but not because you didn't get it from Optimum.

I've had many modems in the past where the upstream power was higher than ~58 dBmV causing intermittent issues where my lines would disconnect without warning repeatedly. I was able to fix it by attenuating the upstream power by using an active return amplifier and downstepping the power to around 45 dBmV. After that I had perfect service. Normally Optimum could check and fix this issue for you, but they won't touch a modem that they don't own.

You could purchase a signal tester online and hook your incoming line to it to view the power quality and strength, then just return it. You'll then have to check your modem to see what the correct voltage is and you'll be able to say with certainty.

Additionally, how long have you had the service? Coaxial degrades over time, especially poor quality coaxial.
